The Trade Unions ("Gewerkschaften") are mis-using
the Unemployment Insurance and
the Social Security system
in order to prevent companies
from employing people
at the correct market-price for labor.
They have to dismiss their employees
because they can't pay them.
But they are not allowed to employ them
for a lower price (lower wages) which they could pay.
The Trade Union does not allow it, and
the Trade Union can enforce that easily
because there is
Unemployment Insurance and
Social Security and
Old Age Pension
for people
who "can't get a job" and
who are fired because
they are only allowed to work and let themselves be employed
at higher wages than companies (or municipalities) can afford.
In order to remain solvent financially,
the companies and municipalities and the State
HAVE to save on employment-cost.
They are not allowed - by the Trade Unions - to save costs
by lowering the wages and
by increasing working hours -
so they only have the option of dismissing personnel.
On top of that, they "dismiss" (they lose)
also the investments
they made in their personnel
in the form of the training they have given them.
[Auditor:] How are people in Germany forbidden to work?
[Helmut Kohl:]
"That's very interesting
to bring up the subject
that people in Germany are FORBIDDEN to work -
while almost everyone talks about
unemployment and
danger of loss of jobs and
closing down enterprises and
not enough places available where people could work. LFBD

"Apart from the Trade Union contracts with employers,
we have Labor Laws and other Laws that apply.

"They are only allowed to work certain hours,
and
if they work longer
(which in certain cases they are not allowed to do at all)
the employer has to pay a higher sum for these extra hours.
The same applies to Saturday- or Sunday-work. LF
"They are not allowed to have two employments [at the same time],
if they wish that.
"They are forced to stop working at a certain age
- they are 'entitled' to stop working, we call it.
"You mentioned the dismissals due to an employer
not being able to pay the wages -
this is true in many cases,
whereby firm owners,
in order to be able to compete on the international market,
produce abroad where labor-cost is cheaper.
So these jobs (work-places, 'Arbeitsplaetze'), too,
get lost to Germans who look for work.
"Another point is:
In some firms there IS work,
but
the firm can't pay high wages,
- some firms don't want to [pay high wages] -
so they tried to employ foreign labor at low costs -
which is considered illegal
as it puts competing firms at a disadvantage
who pay the full price for their labor.
"We have the word 'Schwarz-arbeit', 'black work',
work done by a professional after his normal working hours,
usually at lower costs,
which is - as the name indicates -
'black' = hidden and illegal.
"So he is not allowed to work
to earn some extras,
or to help a relative or neighbor."
[Auditor:] How are people in Germany forbidden to work?
"A firm that cannot anymore pay all its workers or employees
would dismiss them.
"Those who are dismissed get paid Unemployment Benefit
to the amount of about three quarters of their former income,
FOR NO WORK.
"An adventurous concept would be
to let them CONTINUE to work,
and
the State shares the costs
for their continued employment with the firm,
instead of
giving Unemployment Benefit for NO work"
